As per the provisions of the Local Audit and Accountability Act 2014 and the Accounts and Audit Regulations 2015, Burland Parish Council has made its Annual Governance and Accountability Return (AGAR) for the year 2018-19 available for inspection by any interested person, together with all accounting records; books; deeds; contracts; bills; vouchers; receipts and other documents relating to these records.

Burland Parish Council – Vacancies

Burland has nine seats available on the Parish Council, but the Council currently has three vacancies.

These vacancies will be filled via ‘co-option’ – this means that the Council can receive and make nominations for people to fill the vacant places.

The final decision on who will fill these vacancies will be made by the Parish Council at its meeting on 10th June 2019.

6          CASUAL VACANCIES

Three vacancies exist on the Parish Council following the elections on 2nd May 2019 and the co-option of two additional Members at the Annual Parish Council Meeting held on 13th May 2019.

As per the Parish Council’s Standing Orders, the vacancies have been advertised since the Annual Meeting on 13th May 2019.

The Council is now invited to co-opt three individuals to fill the vacancies.

The Clerk will read out the names of any individuals who have indicated that they wish to be considered for the vacancies. Parish Councillors present at the meeting are then asked to nominate individuals. Any nominations must also be seconded. Councillors may nominate any other individuals known to them in addition to the names read out by the Clerk.

Any candidate does not have to be present for the decision, but candidates may be invited to speak in support of their candidature prior to any nomination.

Where two or more persons have been nominated and seconded and none of these persons has received an absolute majority of votes in their favour, the name of the person receiving the least number of votes shall be struck off the list of candidates and a fresh vote taken. This process shall continue until a majority of votes is given in favour of one person.

It is suggested that candidates present are asked to leave the room when the vote is taken.

A tie may be settled by use of the Chairman’s casting vote.

 

RECOMMENDATION:

Members are asked to nominate individuals to fill the vacancies on the Parish Council and vote on any nomination(s).

7.2        End of Year Accounts (1st April 2018 – 31st March 2019)

The following documents comprise the accounts for the financial year 1st April 2018 – 31st March 2019, which have now been audited by the Internal Auditor.

These documents are presented for formal approval of the 2017-18 accounts.

RECOMMENDATION: 

Members are asked to formally approve the accounts for 2018/19.

 

7.3        Internal Audit Report 2018/19

The 2018/19 Internal Audit Report is presented for note and approval by the Council.

Members are asked to approve the 2018/19 report from the Council’s Internal Auditor

 

7.4        External Audit 2018/19

The various documents relating to the external audit of the Council for 2018/19 are presented to Members.

These documents include: –

  • The completed and signed Annual Internal Audit Report 2018/19
  • The uncompleted Annual Governance Statement 2018/19
  • The completed Accounting Statements 2018/19

Members are asked to collectively complete the Annual Governance Statement as a Council during the meeting, as per audit recommendations. Members are also asked to note the other documents listed above.

As reported at the Annual Meeting of the Parish Council in May 2018, the external auditor is now PFK Littlejohn and, in addition, the process of external audit has also changed so that councils whose gross income/expenditure is below £25,000 may certify themselves as exempt from an external ‘limited assurance’ review/audit. This means that the forms described above do not need to be submitted in the usual fashion. See item below.

It is confirmed that the period for the exercise of public rights is between 17th June 2019 and 26th July 2019.

7.5        Annual Governance Statement 2018/19

The Annual Governance Statement 2018/19 is presented for completion and approval by the Council. Following approval, the Statement must be signed by the Chairman (or, in her absence, by the Vice-Chairman) and the Clerk prior to submission to PFK Littlejohn (on or before 1st July 2019).

 

RECOMMENDATION:

Members are asked to agree that the Chairman and Clerk sign the Statement for 2018/19

 

7.6        Accounting Statements 2018/19

The Accounting Statements 2018/19 are presented for note and approval by the Council. Following approval, they must be signed by the Chairman (or, in her absence, by the Vice-Chairman) and the Clerk prior to submission to PFK Littlejohn (by 1st July 2019).

 

RECOMMENDATION: 

Members are asked to agree that the Chairman and Clerk sign the Statement for 2018/19

 

7.7        Certificate of Exemption 2018/19

As outlined above and at previous meetings, local councils with income/expenditure at or below £25,000 in the relevant year are permitted to apply for exemption from external audit review. To do this, the Council must formally approve the attached Certification of Exemption stating the annual gross income/expenditure for the financial year 2018/19. The Council can decide to have a ‘voluntary’ review, but such a review would cost £200.00 plus VAT. It should be noted that the external auditors will carry out assurance reviews on a random sample of 5% of parish councils – whether they have declared themselves exempt or not.

 

RECOMMENDATION:

Members are asked to consider and approve (or otherwise) the attached Certificate of Exemption for 2018/19. If approved, the Certificate must be signed by the Chairman and Clerk.

 

7.8        Ledger/Bank Reconciliation Statement (1st April 2019-31st May 2019)

The ledger/bank reconciliation statement for the period 1st April 2019-31st May 2019 is presented to Members for note.

The Trust’s objective is the provision and maintenance of a recreation ground and building for the benefit of the inhabitants of the area supporting activities and opportunities that improve quality of life and well-being for the whole community and neighbouring parishes.

 

Our mission is to be a community focused enterprise within the village which supports leisure, recreation, physical and emotional health and social interactions for all.

 

The Committee oversees the administration of the Trust and consists of a Chair, Secretary, Treasurer, 5 Elected Trustees and a number of Representative Members from the village recreational clubs.

 

Do you have some spare time to volunteer to support our vision? Do you have any experience in Charity work, Marketing, PR, Fund-raising or Grant applications.

 

We are looking for new a new Secretary, Elected Trustees, Members and

Volunteers to join our committee.

8.1  Local Election Results and Vacancies

Following the elections on 2nd May 2019, four candidates were returned unopposed. There are currently five vacancies and the Parish Council is invited to consider co-opting to each.

The procedure requires a nomination and seconding of the proposal to co-opt, following which a vote will be taken. The successful candidates will then each be asked to sign a Declaration of Acceptance of Office.

The Parish Council is asked to note that Cllr Stan Davies was re-elected as the Borough Councillor for the ward of Wrenbury.

 

9. APPOINTMENTS TO OUTSIDE BODIES
The Parish Council is invited to appoint a representative(s) to the following outside bodies: –

  • Cheshire Association of Local Councils – area meeting
  • Police Cluster meetings
  • Nantwich Local Highways Group

Invitations to attend other outside bodies can be dealt with as and when they arise.

12. FINANCIAL MATTERS
12.1 End of Year Accounts (1st April 2018 – 31st March 2019)

The following documents comprise the draft accounts for the financial year 1st April 2018 – 31st March 2019. The accounts have not yet been audited but were handed over to the Internal Auditor on 24th April 2019. Any report from the internal auditor will be formally presented at the next parish council meeting in June 2019. The documents have been presented for information at this stage. Formal approval of the accounts will take place at the Parish Council meeting in June 2019.

RECOMMENDATION                            

That      Members     note     the     financial information presented.

12.2             Appointment of Internal Auditor

It is a requirement that the Internal Auditor is appointed annually. Members are asked to approve the continued appointment of JDH Business Services for the year 2019-2020.

12.3             External Audit 2018-19

The external auditor covering the 2018-19 financial year is PFK Littlejohn. Parish councils whose gross income/expenditure was £25,000 or less in the financial year in question (and who meet the qualifying criteria) may certify themselves as exempt from a ‘limited assurance’ review. In other words, a parish council who is exempt does not need to submit the usual forms to the external auditor. Despite this exemption, the council must still complete and agree the annual

return form in common with previous years as well as providing narrative support for the figures and information provided. An exempt parish council must also, as per previous years, set dates for the exercise of public rights, where members of the public can examine the accounts.

It would appear from the information provided that Burland Parish Council can declare itself exempt from an external audit for 2018-19. To do this, the Council must agree to complete a Certificate of Exemption stating the annual gross income/expenditure for the 2018-19 financial year. This will be presented to the Council for agreement/otherwise in June 2019. It should be noted that a so-called ‘voluntary’ assurance review by the external auditors would cost the Council £200.00 plus VAT. It should also be noted that the external auditors will carry out assurance reviews on a sample of 5% of parish councils whether they have declared themselves exempt or not. If the parish council is selected as part of this process, there is no charge.

6   2018-2020 NATIONAL SALARY AWARD

The National Joint Council for Local Government Services (NJC) has agreed the new pay scales for the 2018-20 period to be implemented from April 1st 2018 onwards.

The new pay scales are attached for Clerks. Members will note that a new pay spine on 1st April 2019 is also included.

The implications of these changes for Burland Parish Council are set out for Members under Part B of this agenda.

6         NEW HOMES BONUS SCHEME

Cllr David Higham, Vice-Chairman of Audlem Parish Council, will attend the meeting to talk about the New Homes Bonus Scheme, as discussed at the previous meeting of the Parish Council.
